TERMS OF SERVICE (INCLUDING TELEHEALTH DISCLOSURE, PRESCRIPTION DISCLOSURE, AND INFORMED CONSENT)

By accessing this website or purchasing any membership, testing, or services through ASPN Labs (“ASPN,” “we,” “us”), you agree to these Terms of Service.

1. Platform Role; No Emergency Services

ASPN Labs operates as a health optimization and care-coordination platform. ASPN does not provide emergency medical services. If you believe you are experiencing a medical emergency, call 911 or seek immediate in-person medical attention.

2. Medical Services Provided by Independent Licensed Providers

Medical services associated with ASPN Labs are provided by independently licensed healthcare providers. ASPN does not practice medicine and does not control provider clinical decision-making. All evaluations, recommendations, diagnoses (if applicable), and prescribing decisions are made solely by licensed providers.

3. Telehealth Disclosure

Medical consultations may be provided via telehealth (video, phone, or secure electronic communication). Telehealth may not be appropriate for all conditions. Providers may recommend in-person care, referrals, or emergency services when necessary.

State Licensing

Telehealth Services and Jurisdictions

ASPN Labs provides certain services through telemedicine and electronic communication technologies.

Prescription-based medical services are delivered by licensed healthcare providers who are authorized to practice in the jurisdiction where the patient is physically located at the time of consultation.

Patients may only receive medical evaluation, diagnosis, treatment, or prescription services when matched with a healthcare provider who holds an active professional license in the state where the patient is located.

Currently, prescription-based telehealth services through ASPN Labs are available to patients located in the following U.S. states:

Ohio
Oklahoma
New Jersey
Georgia
Nevada
Tennessee
Pennsylvania
Wisconsin
Texas

ASPN Labs may expand service availability as additional providers become licensed in new jurisdictions. This page will be updated as service jurisdictions change.

For clarity, these jurisdictional limitations apply only to prescription-based telehealth services. ASPN Labs also offers wellness products, supplements, and diagnostic testing kits that may be available nationwide, subject to applicable shipping and regulatory requirements.

4. Prescription & Pharmacy Disclosure

ASPN Labs does not operate as a pharmacy and does not sell or dispense prescription medications.

When clinically appropriate, prescriptions may be issued only by licensed healthcare providers following medical intake and review. Prescriptions are fulfilled by independent, state-licensed U.S. pharmacies in accordance with state and federal laws. Prescription approval is not guaranteed and is based solely on medical judgment and eligibility.

ASPN Labs does not provide or recommend products labeled “for research use only” or “not for human consumption.”

5. Informed Consent; Off-Label Prescribing

By using ASPN Labs’ services, you acknowledge:

• All care is subject to medical review and eligibility.

• Therapies, diagnostics, supplements, and lifestyle recommendations may carry risks and benefits, and responses vary by individual.

• Some therapies may be prescribed off-label, which is a legal and common medical practice when deemed clinically appropriate by a licensed provider.

• You may ask questions, seek clarification, decline recommendations, or discontinue services at any time.

• No guarantees are made regarding outcomes, performance improvements, or results.

7. Memberships and Service Eligibility

Membership features, testing, and services may vary. ASPN may modify offerings over time. All services are subject to medical appropriateness and availability.

8. Prohibited Use

You agree not to misuse the website or services, including attempting to obtain prescription products without medical review, providing false information, or using the platform in violation of law.
